WELCOME TO YAM!

Yam is an online platform designed for Fans and Creators to make an interactive connection while exploring the content, project, or product posted by their favorite Creators. By creating an account and signing up for a subscription, Fans can access to the any projects or products and to enjoy exclusive contents of the Creators on our platform. Please read the content below to clearly understand about how you can use and manage your rights – responsibilities and other relevant regulations when you use our services. We hope that Creator and Fan can have a better understanding of our services through this Terms of Use.

DEFINITION

  1. This Terms of Use (the “Terms”) shall apply to Creators (refer to “users”,“you” or “your”) in order to have access to our services. You can easily find these Terms at the Homepage screen on the app and the website.
  2. “Services” refers to all services that Yam provides on our platform which can be used on various wired and wireless devices such as PCs, laptops (websites), mobile devices (apps) or any devices capable of broadcasting similar to those devices mentioned above. Note that only users who register as a Creator account can access our services and features on the website.
  3. “Content” refers to the messages, images, videos, livestreams, or any other works in form of information such as text, voice, audio, images, and videos uploaded on Yam when you use our services.
  4. “Fans” are users who register for a fan account, which allowed to have access to the content, products, or any projects of the creators on our platform.
  5. “Creators” are users who register for a creator account, allowed to post their works, products and projects on our platform.
  6. “Token” is an intermediary payment unit, a conversion tool in transactions between Creator and Fan on Yam. Tokens are not a monetary currency. In addition, the Token also shows Fan’s interest and evaluation of the Creator’s product content such as images, music, video on demand, etc. in the form of giving tokens to the Creator.
  7. “Charged Service” means Creator services for a fee. Charged Services will be paid for through our Tokens on the Yam platform. When Fan uses Charged Services, Fan will be required to pay related fees to Creator through Yam platform. We will notify you in advance in the event that any service that you will or may use is a Charged Service as set forth in these terms of use.

HOW TO USE OUR SERVICES!

  1. You must be at least 16 (sixteen) years old or above in order to use our services. Users between the age of 14 and 16 must have full permission from their parents or legal guardian to use our services.
  2. To get started as a Creator, you need to create an account in the Creator Subscriptions section. You must provide accurate information and agree to our terms to be granted an account and access to our services. You are allowed to use this account to connect with your Fans, update news of your products or projects, content, or subscriptions so that Fans can register for it. Yam is truly a place that allowed you to create multiple Fan groups and directly chat with them.
  3. Yam only provides the platform allowing Creators and Fan to connect and interact through products and services of Creators, who are responsible for any content or works uploaded on our platform. They can easily create works and projects to offer separate benefit packages for their fans. For each subscription, Fans will have access to various content and benefits of creator’s products, specifically these benefits will be listed precisely by Creator before Fans decide to proceed any payment for the benefits package.
  4. If you wish to delete or suspend your account, please contact us at [email protected] for further support. Once you choose to delete your account, you agree that you won’t have any complaints or take any actions against us for deleting or suspending your account. In case you still want to take these actions, you must pay for any losses from those actions, including attorney’s costs.
  5. In case the content you post on our platform is contrary to our regulations, policies or any provisions of law, we may terminate or suspend your account, including but not limited to the right to unsubscribe, delete any of your comments, posts, followers, or tokens at any time depending on our decision.
  6. You may give Yam access to your third-party accounts, such as Google, YouTube, etc., in order to enable some features on Yam. Once you connect, that third-party account will display a page describing information that Yam can access.

CREATOR COMMITMENT, GUARANTEE

  1. The Creator commits, makes sure not to provide any payment methods, payment gateways for Fan support except the methods provided on the Yam application, including but not limited to images, content, words, actions on general information, introductory information, video, livestream and other forms, directly or indirectly send illegal information to Fan.
  2. In case the Creator violates the rules, Yam will send the 1st reminder email to the Creator when detecting violations, Creator has 24 (twenty-four) hours to remove the infringing content.
  3. If after the above time limit, Creator still does not remove the infringing content, Yam will send a 2nd reminder email. In case We still do not receive any compliance action from Creator, Yam will proceed to deactivate the account after 24 (twenty-four) hours from the time of sending the 2nd reminder email. Besides, Yam will proceed to record the information of the violating Creator to the block list after 24 (twenty-four) hours from the time of disabling the Creator’s account. Please note that We will not process the withdrawal and payment request to the Creator in case the Creator’s account is disabled due to the violation of the above policy.

TOKENS, CHARGED SERVICE, PAYMENTS AND WITHDRAW

  1. Yam is an intermediary platform connecting Creators and Fans, we do not attain any benefits from Fans during your access to Creator projects or products. Therefore, all transactions of any parties must be conducted on Yam, as both users agree that we will be the representatives for collecting and transferring payment, as well as the direct monitor of Creator’s incomes and Fan’s spending for these transactions.
  2. To withdraw money from Creator account on social media, we do not force Creator to connect immediately your personal bank account with Yam account at the moment you register for a Creator account or when you upload products, projects information and images on our platform. In order to withdraw money from collected Tokens, Creators are required to provide information of their bank account with its holder’s full name is the same as that account username information provided before. When Creators need to adjust the withdrawal account number, please send to us the updated information at least 05 (five) days prior to the estimated withdrawal date.
  3. When the Creator joins the Yam platform, the platform usage fee is calculated at 22%, this fee included the fees charged from the payment gateway. We will also assist the Creator with the payment of taxes with the authorities and other assistance covered by Our Policies. We understand that you agree to this content by agreeing to our Terms of Use.
  4. We are not liable for any responsibility in certain situations such as Creators unauthorized bank account, or adjusting the withdrawal bank account without prior notices, resulting in not receiving money from Yam, or transfer money into account that you do not wish for. Please check your bank details carefully before clicking confirm withdrawal.
  5. Redeem Tokens: Users from the age of 16 who have registered for our Fan account can redeem tokens using payment methods provided by a third-party online payment service provider that Yam platform acknowledged and authorized.
  6. The value of the token will be shown at the time of redemption. All token redemption fees and payments will be made in the currency specified at the time of redemption via the applicable payment method. Conversion payments, transaction fees, and payment channel fees (if applicable), as per your agreement with the relevant payment service provider.
  7. Any payments will be non-refundable and there will not be any refunds or credits for partial time usage. We reserve the right (but not the obligation), in our sole discretion, to refund an amount already paid if there is a technical fault with the purchased service.
  8. Access to a Chargeable Service is conditional upon you confirming your acceptance and payment of the fees for these Chargeable Services. For the avoidance of doubt, we are under no obligation to provide you with any Chargeable Services if you do not pay a fee for these services.
  9. The Creator reserves the right to change the price of the service at any time, at the Creator’s sole discretion and without any liability to the Fan. Any Charged Services will not be maintained in your account in the event you delete your account or the account is otherwise terminated in accordance with these terms of use.

NOTE WHEN USING TOKENS

  1. Tokens may only be used on our Yam platform and as part of the services we provide.
  2. Tokens are only used to pay for the Charged Services and give to the Creator, and are not transferable to any Fan or to any other third party, unless you have obtained permission from us as clearly shown in the picture, textual consciousness. The sale, exchange, transfer or disposal of any tokens, which are not ours, is strictly prohibited. Fans who violate this provision may have their accounts terminated, lose the number of Tokens in the account and/or be liable for damages as well as transaction costs incurred in the course of litigation.
  3. Tokens have a shelf life of 01 (one) year from the date of redemption.
  4. You agree that we reserve the right to manage, regulate, control, modify, and remove Tokens when we have good cause, such as when we have evidence that you have infringed content. In this policy, or violate any applicable law or regulation or for legal, security or technical reasons and we have absolutely no liability to you based on our exercise of your right.
  5. Token that can be redeemed through the payment gateways that We provide are displayed when making the redemption.

Deactivate account

Creators’ account will be disabled/deactivated if not used within 01 (one) year since your last log in.

Creators can deactivate your account at any time within 01 (one) year started since your account is disabled. Please contact us via email at [email protected] as you wish to be returned intact Tokens that are in your possession before your account was disabled.

Request to delete the account

When we receive your request to delete Creator account, we will conduct a review and a customer support department shall contact the account holder to verify and find out the cause. Creators then shall have 07 (seven) days to change your mind before we proceed to delete account. Please contact us as you wish to withdraw Tokens before deleting your account.

YOU NEED TO FOLLOW THE FOLLOWING RULES

  1. You are required not to share, buy, sell, or exchange user account information and information and content that you obtain when you have registered to use our services and/or service packages. of the Creator.   3. The copyright of the products, content and projects that Creator posts on Yam belongs to the creator of the post, ie Creator. Copyright and all intellectual property rights to the service on Yam application belong to us. We only grant Fan the right to use the service after you agree to the terms and conditions set forth by us.
  4. You will be responsible for all activity on your account and we may delete your Yam account if it violates our policies and regulations. You must not perform illegal acts, insult others or take advantage of Yam to perform illegal acts. Details can be found in the Community Guidelines and Privacy Policy. These policies cover almost any issue that may arise, but if you take other actions that harm Yam, interfere with our business or our community, we will take action. action to prevent such action.
  5. In order to use Yam properly, the following acts are strictly prohibited during the use of the service: providing false information when registering for an account or changing information; stealing other people’s information; unauthorized collection, disclosure or provision of personal data, registration data or usage history of other users; pose a risk to account security such as allowing others to access your account; spreading false information for the purpose of profiting from your or someone else’s property; or cause damage to others; discriminatory or damage the reputation of individuals or organizations.
  6. In addition, we do not allow changes to the information published by us and the use of the service for profit without our consent. You are also prohibited from sending or publishing information other than that specified by us, accessing the service’s servers and the network in unauthorized ways (by using automated programs). ).   1. During the use of the service, we may change or stop the free services to suit our operating situation from time to time.

Accounts are tied to one Creator and cannot be sold or transferred to another Creator for use.

DISPUTE RESOLUTION

  1. We encourage you to contact us when you have a problem and always give priority to solving problems by exchange, negotiation, negotiation. If a dispute arises out of these terms or related to your use of Yam, such dispute will be applied in accordance with the laws of Vietnam and will be resolved in the competent People’s Court in Vietnam. .   3. To the extent permitted by law, we are not liable to you for any incidental or consequential damages arising from these terms when you use Yam.
  4. To the extent permitted by law, our liability for damages is limited to the amount of money we earn through your use of Yam. We are not specifically liable for losses related to unrealized benefits and losses due to contract conflicts.
